Commercial Leases in Texas

COMMERCIAL LEASE

commercial lease is an agreement between a Landlord and Tenant concerning business rental property. Examples include office spaces, warehouses, restaurants, cell towers,  industrial property, and ground leases.

Your lease will include business points and parties usually first presented in a Letter of Intent (LOI) with the real estate agents involvement. Since the commercial lease involves long terms and significant money, it is wise to determine your rights, duties and liabilities before signing.

The experience I have in writing and negotiating commercial leases from both the tenant and landlord perspective provides the foundation for my lease review practice. Once I understand your business needs we compare your needs to the lease offered to you by the owner/landlord.

What to Review before executing a Commercial Lease

Here’s a list of items we suggest reviewing prior to signing your lease:

  • Your present situation

  • Your plans for the real estate

  • Your lease terms and conditions

  • Your lease exhibits and guarantees.

  • What cost are apparent and built into your lease that will affect your business decision?

  • What are your cost, the true effective dates of obligations?

  • What expenses and tax issues should you consider?

  • What tenant improvement language provides you adequate allowance coupled with control of the finish out?

  • How do you cap costs and recapture unused allowances?

  • How should you structure the lease agreement to provide for an exit plan for your business?
